Please read the following Terms and Conditions in full if you are engaging with the services of Midlands ADHD Clinic.
This document outlines conditions with regard to accessing our service, patient safety, patient responsibilities, consent, information provided, attendance, GP communication, payments, cancellations and conditions around ADHD assessments, medication and therapy plus information on safe working, data processing and liability.
1. General Outline
The following Terms and Conditions outline the expectations for the service user when engaging with Midlands ADHD Clinic. This is a contract between the patient and Midlands ADHD Clinic, created to ensure both parties are aware of their responsibilities and protected in the rare event that a disagreement occurs. Please read in full and contact us if you have any questions.
When you use the services of Midlands ADHD Clinic (called “Midlands ADHD Clinic” or “we” in these terms), engaging in any capacity, you agree to these terms and conditions. This includes using our website (www.midlandsadhdclinic.com) or any of our online or face to face services. You also agree to follow any other policies or instructions we provide, either through our systems or directly from our team.
All patients accessing our service through the Right to Choose pathway will be cared for under the terms of our NHS Right to Choose Contract, as well as these terms and conditions.
These Terms and Condition also include our Privacy Policy which is held on our website.
2. Access To Our Service
Your initial referral information will be triaged by a member of our team. Our decision about your care is based on the information you provide in your referral.
We are not obliged to seek additional details, so it is your responsibility to share any information relevant to your assessment and treatment so we can make an accurate decision.
On occasion, we may not take on your case. It could be due to our Eligibility Criteria, or if we are unable to meet your needs. If this occurs, any payments taken at the initial referral stage, will be refunded.
If your case has been rejected due to your omission in the registration form/ self-referral form, we may deduct from the refund the card payment fees, plus a £20 admin fee. We may also discontinue treatment if it becomes inappropriate to continue, for example you may need a higher level of care than we can provide. We will aim to direct you to an alternative service or refer you back to your GP.
3. Patient Safety
Midlands ADHD Clinic provides an Outpatient Consultation Service Only. We are unable to support or treat patients in crisis, emergency in high-risk situations, or patients contacting us outside of working hours. If you mental or physical health deteriorates, or you find yourself in an emergency situation (being at risk from suicidal thoughts, physical emergency or threat from others) please go to your nearest A&E or call Police/ Ambulance on 999 or 111 for advice.
4. Confidentiality
In certain situations, we may be legally required to share your personal information. This may be to your next of kin and/ or other services (i.e., GP/ Safeguarding team). This could include instances when we have concerns about your safety or that of a vulnerable adult or child, regarding a serious crime or act of terrorism or regarding safeguarding or child protection. You accept that we are legally obligated to make such disclosures when necessary.
If someone else is paying for your sessions (i.e., a family member, friend or a company) and they enquire about your attendance, we may provide limited information pertaining to which sessions have been attended/ cancelled.
If you have named another person to have access to your profile, or provided their email/ telephone number to us as your main point of contact, this individual may have access to your clinical information and appointment details.
If you have undertaken an ADHD assessment or medication assessment/ titration, your information will be shared with your GP or other relevant medical practitioner.
5. Patient Responsibilities
You agree that, as the patient or parent/ carer of the patient, you have full authority to enter into this agreement.
You give permission for Midlands ADHD Clinic to share information with medical professionals (i.e. GP, NHS or other specialists) where required, and will need to use information from other professionals in providing a service.
If you are a parent or carer of a child using the service, you agree that everyone with parental responsibility has consented to using the services of Midlands ADHD Clinic.
When a child or young person is deemed mature enough to make their own treatment decisions under the principles of Gillick Competence, we are legally required to respect their choices. This includes situations where they refuse treatment, withhold consent to share their records (including with family), or do not allow communication with their parents. You acknowledge that we must uphold these confidentiality obligations and accept that we are not responsible for doing so at the patient’s request.
Information Provided & Processes
You confirm that all information you provided (including regarding your physical and mental health) is accurate, honest and in English or in the language pre-agreed with the clinic at triage. If your personal information becomes inaccurate, incomplete or out of date that you will inform us in writing as soon as you are aware.
You agree not to alter any documents created or completed when using the services of Midlands ADHD Clinic.
You agree to follow all instructions you are given by our team or Clinician. This includes direction regarding assessments (i.e. QB), use of medicines or other health information.
Attendance
You confirm it is the responsibility of you, the patient (or parent/carer) to make sure all appointments are attended on time, fully sober (not under the influence of alcohol or drugs) and able to communicate verbally.
You accept that late attendance or non-attendance of an appointment will incur a fee in line with our Refund Policy, which is held on the website.
Neither party will record any of the sessions with any type of recording device unless written prior agreement of both parties has been given.
For all remote sessions, you agree to be in a private safe environment (building) during remote clinical interviews, with a working camera, mic and internet connection.
For remote sessions, you agree to provide photo ID at the initiation of your appointment. One form of identification from level 1 and also 2 is required. Level 1: Driving License, Passport, original Birth certificate. Level 2: Utility bill, council tax bill, bank statements, hospital letter (from within the last three months). For children we require a school identification letter/ card or passport.
6. Communicating with your GP
If you are seeking a private assessment and intend to return to your NHS GP for follow-up tests, monitoring, prescribing, or any other related services, we strongly recommend that you speak with your GP beforehand to confirm whether they are willing to provide this support. Some GPs may choose not to do so, and we cannot accept any responsibility if this occurs. If your GP is unable or unwilling to assist, you may need to arrange the necessary services privately.
7. ADHD Assessment Services
A positive diagnosis of ADHD pertains to whether information presented during the assessment meets criteria according to the DSM- 5 on what constitutes ADHD.
On rare occasions there may not be enough evidence to offer a definitive diagnosis (i.e. lacking childhood information/ other diagnoses that seem more relevant). If this is the case, we will discuss this outcome and provide a care plan for treatment/ further support.
Once the assessment has taken place and the outcome provided in feedback, should you require further sessions to discuss the outcome, this may be provided by either the same or a different clinician, charged at their usual hourly rate.
You understand that, on occasion, two Clinicians can hold different opinions on the same symptoms or condition, as evidence can be complex and both Clinicians may hold reasonable views with evidence. This can occur in a service of high quality, as medical opinion can differ and does not reflect on the quality of the service as a whole.
For self funding clients, your standard ADHD Assessment fee only includes the assessment pertaining to a diagnosis and does not include any further appointments, treatment or additional tests that may be needed (i.e. QB Check).
8. Medication Services
Prior to commencing medication, we may request additional tests and/ or medication information as required. Medication will not commence until your Clinician believes it is appropriate to do so.
You understand that we offer medical treatment which can carry a risk of side-effects, complications and symptoms with withdrawal. These effects could be increased if you do not follow medical advice. If this occurs, we may cease treatment in order to keep you safe.
You agree to promptly let us know, in writing if possible, about any side effects or unexpected reactions to treatments we have suggested.
You agree to be careful in storing prescribed medications safely, out of the reach of children, and in a secure place.
When prescriptions are provided, they will be private (non- NHS) unless discussed as alternative options during your consultation. Private prescriptions are dispensed through an online pharmacy whom we have a prior relationship with. The prescriptions may take around 5-8 working days to reach you due to the legislation that prescriptions need to be posted via Royal Mail to the dispensing pharmacy. Please provide us with an up-to-date address for postage. We are not responsible for delayed or lost prescriptions sent in the post, or delays of medication sent from the pharmacy.
You have the right, at your own discretion, to stop treatment. If you do so you accept that there could be side-effects and or withdrawal symptoms and other complications of which you take sole responsibility.
9. Payments
Provision of services by Midlands ADHD Clinic is subject to receiving payment in full prior to that appointment at time of booking. Appointments cannot be held without payment in full in advance.
If another party is paying for your services, this payment must be preauthorised in writing, prior to booking the service. The third party should be made aware of these terms and conditions, by you the patient, and that any non-patient payers are bound by the provisions of these terms and conditions, including the cancellation fees.
As the patient you are responsible for paying, in full, all Insurance excess fees within seven day of the insurance company indicating the required amount.
When booking a consultation (including a six month or yearly follow up), you give Midlands ADHD Clinic permission to charge your debit/ credit card in your account before the provision of services. You agree for Midlands ADHD to take payment from your stored card, up to 14 days prior to the appointment for six month and 1 yearly reviews.
If a card payment is declined, we will make reasonable attempts to contact you by phone and/ or email. If payment is not made within 7 days of the appointment your appointment will be cancelled and your service may be suspended or cancelled at the discretion of Midlands ADHD Clinic.
You agree that any unpaid amounts shall bear daily interest of 10% per annum above the Bank of England lending rate and that fees for collection, including Court Costs and reasonable legal costs shall be added to the balance.
Midlands ADHD Clinic reserves the right to amend its prices or fees at any time before your consultation is billed. You agree that your appointment or service may be cancelled if your payment information is incorrect, invalid, lacks sufficient funds, or if any third-party pre-authorization is declined or we receive a negative response.
You agree that if you breach the terms and conditions of this contract or withdraw from our services, you will still remain liable for payments that are due to Midlands ADHD Clinic.
The ADHD assessment fee is for a formal ADHD Assessment, based on NICE guidelines and does not include medication or therapy. Should you wish to pursue medication or therapy/ ADHD coaching, we can offer this for an additional fee.
10. Cancellations
We have a strict 48-hour cancellation policy which applies to both private and NHS patients. NHS patients may lose their opportunity with our service if an appointment is cancelled with less than 48 hours’ notice. Self-funding private patients will incur a cancellation fee/ fee to rebook.
For Health Insurance Clients: Please note that your Health Insurance does not cover cancellation fees. If cancellation fees arise we will invoice you directly and require payment by card.
If you attend your appointment but fail to meet the necessary conditions for a safe consultation, your appointment will be treated as cancelled, and the applicable cancellation conditions outlined below will apply. Such conditions include, but are not limited to: being sober (not under the influence of alcohol or drugs), arriving on time, and, for remote consultations, participating from a private and secure indoor location (not a vehicle) with a fully functioning camera, microphone, and reliable internet connection.
If you cancel your medication review, this may impact your ability to obtain your next prescription before your current supply runs out. We cannot accept responsibility for any interruption in medication, including where this results from limited availability of review appointments..
We are unable to offer a refund should you be unhappy with the clinical outcome of the assessment or treatment offered.
If you request a refund within 48 hours of paying the fee for assessment, we will refund the fee paid, minus the card payment fee and £20 admin fee. This is on the condition that no pre-assessment questionnaires have been sent.
If you should require a refund once your pre-assessment questionnaires have been sent, but none have been submitted, we will refund the fee paid minus a £100 admin fee and the card payment fee.
Once any pre-assessment questionnaires have been submitted, the ADHD assessment fee is non- refundable.
If you are late, the assessment conditions are not met (see point 5), or you cancel or reschedule your clinical interview with less than 48 hours’ notice, an additional clinical interview will be required and charged at £150 per hour. Please note that an ADHD assessment requires three hours of clinical time.
It is the responsibility of the patient to inform Midlands ADHD Clinic, at least 7 days before a medication review, if it is no longer required.
Should a Medication Consultation (Assessment and/ or Review) be charged and then cancelled by the patient (outside of our cancellation period) as it is no longer required, we will refund the fee minus charged from the card processing company, minus a £20 admin fee.
If you request a refund for a medication consultation, outside of the 48 hours cancellation fee, we will refund the fee minus the card payment fee and £20 admin fee.
With regard to Medication Consultations, appointments cancelled between 48 hours and 24 hours will incur a 50% charge of the scheduled fee. Appointments cancelled with less than 24 hours’ notice will incur the full fee as a cancellation charge.
Should you cancel your appointment with less than 48 hours’ notice, the appointment will be charged to the NHS, and you may forfeit your opportunity to access our services. If two appointments are cancelled with less than 28 hours’ notice, we will be required to discharge you, in accordance with the requirements of our Right to Choose contract.
Therapy sessions are subject to the Terms and Conditions for Malvern Hills Private Practice. Further details are held on their website www.malvernhillsprivatepractice.co.uk. Specifically, they have a 48-hour cancellation policy. Sessions cancelled between 48 and 24 hours are a half fee. Sessions cancelled in under 24 hours are a full fee.
11. Safe Working Environment
At Midlands ADHD Clinic, we are dedicated to creating a caring, safe, and respectful space for both our patients and our team. We do not tolerate any form of mistreatment or abusive behaviour toward our staff. If someone behaves in a harmful or abusive way toward our staff, consequences may include being discharged from our services and/ or notification to the relevant authorities. In the event that we judge your communication or behaviour as abusive we may withdraw our service and you will not be eligible for a refund for services delivered.
12. Data Processing
Collection of personal information is essential to be able to provide services to you. All data provided will be processed in accordance with the Data Protection Act 2018/UK GDPR. Please see our Privacy Policy for full details. By agreeing to these terms and conditions you are agreeing also to our Privacy Policy which forms part of our mutual contract.
13. Liability Limitation
Midlands ADHD Clinic does not guarantee that our services or your patient data will fully meet your needs, operate without interruption, be completely secure, or be free from errors. We cannot promise that any faults or issues will always be fixed. Midlands ADHD Clinic is not liable for any errors, corruption, or breaches of data that occur during transmission via local networks or telecommunications providers.
By accepting our terms and condition you are in agreement that Midlands ADHD Clinic isn’t responsible for any losses that aren’t caused by something we’ve done wrong, business-related losses (like loss of profit, income, contracts, savings, data, goodwill, or wasted costs), or indirect or unexpected losses that neither you nor we could have anticipated when you started using our services.
Our clinicians use their professional judgement and the information you provide, to prepare prescriptions, GP letters, and similar documents in line with our legal duties. Because each situation is unique, we can’t guarantee that these documents will always include everything you expected, hoped for, or understood they would contain.
Sometimes, things happen that are beyond our control. If this affects our ability to provide services on time, we’ll let you know as soon as possible and do everything we can to reduce any delay or disruption.
The maximum amount Midlands ADHD Clinic could be held liable for in any single claim is limited to a maximum of £50,000.
Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
If a court decides that any part of these Terms and Conditions can’t be enforced, the rest will still apply as each section works on its own. If we don’t act right away when these terms are breached, that doesn’t mean we’re giving up our right to act later to uphold the agreement.

If you are late, the assessment conditions are not met (see point 5), or you cancel or reschedule your clinical interview with less than 48 hours’ notice, an additional clinical interview will be required and charged at £150 per hour. Please note that an ADHD assessment requires three hours of clinical time.
It is the responsibility of the patient to inform Midlands ADHD Clinic, at least 7 days before a medication review, if it is no longer required.
Should a Medication Consultation (Assessment and/ or Review) be charged and then cancelled by the patient (outside of our cancellation period) as it is no longer required, we will refund the fee minus charged from the card processing company, minus a £20 admin fee.
If you request a refund for a medication consultation, outside of the 48 hours cancellation fee, we will refund the fee minus the card payment fee and £20 admin fee.
With regard to Medication Consultations, appointments cancelled between 48 hours and 24 hours will incur a 50% charge of the scheduled fee. Appointments cancelled with less than 24 hours’ notice will incur the full fee as a cancellation charge.
Should you cancel your appointment with less than 48 hours’ notice, the appointment will be charged to the NHS, and you may forfeit your opportunity to access our services. If two appointments are cancelled with less than 28 hours’ notice, we will be required to discharge you, in accordance with the requirements of our Right to Choose contract.
Therapy sessions are subject to the Terms and Conditions for Malvern Hills Private Practice. Further details are held on their website www.malvernhillsprivatepractice.co.uk. Specifically, they have a 48-hour cancellation policy. Sessions cancelled between 48 and 24 hours are a half fee. Sessions cancelled in under 24 hours are a full fee.
11. Safe Working Environment
At Midlands ADHD Clinic, we are dedicated to creating a caring, safe, and respectful space for both our patients and our team. We do not tolerate any form of mistreatment or abusive behaviour toward our staff. If someone behaves in a harmful or abusive way toward our staff, consequences may include being discharged from our services and/ or notification to the relevant authorities. In the event that we judge your communication or behaviour as abusive we may withdraw our service and you will not be eligible for a refund for services delivered.
12. Data Processing
Collection of personal information is essential to be able to provide services to you. All data provided will be processed in accordance with the Data Protection Act 2018/UK GDPR. Please see our Privacy Policy for full details. By agreeing to these terms and conditions you are agreeing also to our Privacy Policy which forms part of our mutual contract.
13. Liability Limitation
Midlands ADHD Clinic does not guarantee that our services or your patient data will fully meet your needs, operate without interruption, be completely secure, or be free from errors. We cannot promise that any faults or issues will always be fixed. Midlands ADHD Clinic is not liable for any errors, corruption, or breaches of data that occur during transmission via local networks or telecommunications providers.
By accepting our terms and condition you are in agreement that Midlands ADHD Clinic isn’t responsible for any losses that aren’t caused by something we’ve done wrong, business-related losses (like loss of profit, income, contracts, savings, data, goodwill, or wasted costs), or indirect or unexpected losses that neither you nor we could have anticipated when you started using our services.
Our clinicians use their professional judgement and the information you provide, to prepare prescriptions, GP letters, and similar documents in line with our legal duties. Because each situation is unique, we can’t guarantee that these documents will always include everything you expected, hoped for, or understood they would contain.
Sometimes, things happen that are beyond our control. If this affects our ability to provide services on time, we’ll let you know as soon as possible and do everything we can to reduce any delay or disruption.
The maximum amount Midlands ADHD Clinic could be held liable for in any single claim is limited to a maximum of £50,000.
Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
If a court decides that any part of these Terms and Conditions can’t be enforced, the rest will still apply as each section works on its own. If we don’t act right away when these terms are breached, that doesn’t mean we’re giving up our right to act later to uphold the agreement.
